Diálogos sobre BIM 2021 - BIM and Copyright

On June 23, 2021, João Gaspar, architect and director of TI Lab and ProBooks Editora, gave a presentation on BIM and Copyright, part of the Diálogos sobre BIM series, 2021 season!

The relationship between BIM and copyright is very important, and it's a topic rarely addressed. In the talk, Gaspar began by presenting the definition of BIM to be considered for this topic, given that "the meaning attributed to BIM varies quite a bit". Next, he covered the duties and fields of practice of the Architect and Urban Planner, and what constitutes an architecture and urban planning service. Architect João Gaspar noted that an architecture and urban planning service is determined by the professional's assigned duties and field of practice.

The discussion went on to address how it's possible to deliver an architecture and urban planning service, what products are to be delivered, and how those products become deliverable documents. Gaspar stated that "a product becomes a document when it is fixed, recorded, captured, etc. on a physical or digital medium". Therefore, Gaspar noted that a digital document also has authorship that can be attributed and proven. From this, it follows that copyright applies to BIM processes and models.

The presentation covered which types of works are protected under Law 9610, on Copyright. Gaspar explained how the author is defined, whether a work must be registered to have recognized copyright, and what the difference is between moral and economic rights. At the end of the presentation, the architect discussed how it's possible to register the authorship of a BIM process or BIM model in the CAU/SR system (SICCAU), and what the difference is between registering authorship (RDA) and an RRT.
